9th Circuit: Judges Should Not Pretend to be Scientists

Hallelujah! The Ninth Circuit Court of Appeals has reversed an appeals court, admonishing the judges that they should not presume themselves to be more knowledgeable than the scientists. Hopefully, this decision will reopen some of the sillier decisions, such as this decision by an Oregon judge that wild salmon and hatchery raised salmon are two different species solely because of where of they are hatched. Scientists say they are genetically the same, yet this judge made the illogical, unscientific leap that they are different and caved completely to the environmentalists who also happen to want to breach our dams.

This ruling could also be important when the lawsuits over global warming begin hitting the courts.
