Deputy Assistant Attorney General advised Pentagon in 2001 that military may ignore Bill of Rights on U.S. soil

OLC Authorized Pentagon to Ignore Bill of Rights On U.S. Soil

The Washington Independent | By Daphne Eviatar | 3/2/09

In an October 2001 memo released on Monday, then-Deputy Assistant Attorney General in the Office of Legal Counsel John Yoo advised the Pentagon’s top lawyer that the president may not only deploy the military within the United States, but it may ignore the Bill of Rights in the process of doing so. Yoo and special counsel Robert Delahunty wrote to Defense Department general counsel William Haynes that the president has “ample constitutional and statutory authority to deploy the military against international or foreign terrorists operating within the United States,” and that the use of military force “need not follow the exact procedures that govern law enforcement operations.”

Although the Fourth Amendment of the U.S. Constitution prohibits unreasonable searches and seizures on U.S. soil, Yoo concluded that “[a]lthough the situation is novel … we think that the better view is that the Fourth Amendment would not apply in these circumstances. Thus, for example, we do not think that a military commander carrying out a raid on a terrorist cell would be required to demonstrate probably cause or to obtain a warrant.”

This memo appears to have formed the legal basis for the Bush administration’s domestic warrantless wiretapping program, which at least one federal judge has since concluded was unconstitutional.

Jameel Jaffer, Director of the ACLU National Security Project, reads it as extending beyond the Fourth Amendment, however.

“This takes the position that the Bill of Rights does not constrain the military in its operations inside the United States,” Jaffer told me this afternoon. “The president can disregard the constitution during wartime, not just on foreign battlefields, but inside the United States. We had not seen a memo saying that before.”

The Department of Homeland Security's Operation "ENDGAME" - martial law and elimination of American patriots

In light of recent developments (ie, looming mass civil unrest, troops preparing for martial law inside the U.S.) Organized Jewry may may be looking to make a final move against American patriots in the very near future. Based on the following article, approximately one million American patriots are now on a Jewish Occupied Government (JOG) list, targetted for "removal"...with detention camps, railcars with shackles, and all sorts of legislation and executive orders (authorizing martial law, secret arrests and trials) in place to facilitate this goal.

Things look like they are coming to a head. It may be years before they make their final move. Or it could be months or weeks. My advise for patriots: This is war. Stock up on ammunition, and storable food. Obtain CB radios to maintain communication should internet and phone communications be cut. Network with like-minded individuals in your area, and plan actions to be taken when TSHTF. Most importantly, get your 'spiritual' house in order, and prepare yourself to fight to the end for all that you hold dear. Lastly, I would mention that we have been on the defensive for too long. It's time to go on the offensive. Start compiling lists of jews, traitors, and other important targets in your area, to be dealt with at the appropriate time.

Rule by fear or rule by law?

San Francisco Chronicle | Lewis Seiler,Dan Hamburg | Monday, February 4, 2008

Since 9/11, and seemingly without the notice of most Americans, the federal government has assumed the authority to institute martial law, arrest a wide swath of dissidents (citizen and noncitizen alike), and detain people without legal or constitutional recourse in the event of "an emergency influx of immigrants in the U.S., or to support the rapid development of new programs."

Beginning in 1999, the government has entered into a series of single-bid contracts with Halliburton subsidiary Kellogg, Brown and Root (KBR) to build detention camps at undisclosed locations within the United States. The government has also contracted with several companies to build thousands of railcars, some reportedly equipped with shackles, ostensibly to transport detainees.

According to diplomat and author Peter Dale Scott, the KBR contract is part of a Homeland Security plan titled ENDGAME, which sets as its goal the removal of "all removable aliens" and "potential terrorists."

Fraud-busters such as Rep. Henry Waxman, D-Los Angeles, have complained about these contracts, saying that more taxpayer dollars should not go to taxpayer-gouging Halliburton. But the real question is: What kind of "new programs" require the construction and refurbishment of detention facilities in nearly every state of the union with the capacity to house perhaps millions of people?

Sect. 1042 of the 2007 National Defense Authorization Act (NDAA), "Use of the Armed Forces in Major Public Emergencies," gives the executive the power to invoke martial law. For the first time in more than a century, the president is now authorized to use the military in response to "a natural disaster, a disease outbreak, a terrorist attack or any other condition in which the President determines that domestic violence has occurred to the extent that state officials cannot maintain public order."

The Military Commissions Act of 2006, rammed through Congress just before the 2006 midterm elections, allows for the indefinite imprisonment of anyone who donates money to a charity that turns up on a list of "terrorist" organizations, or who speaks out against the government's policies. The law calls for secret trials for citizens and noncitizens alike.

Also in 2007, the White House quietly issued National Security Presidential Directive 51 (NSPD-51), to ensure "continuity of government" in the event of what the document vaguely calls a "catastrophic emergency." Should the president determine that such an emergency has occurred, he and he alone is empowered to do whatever he deems necessary to ensure "continuity of government." This could include everything from canceling elections to suspending the Constitution to launching a nuclear attack. Congress has yet to hold a single hearing on NSPD-51.

U.S. Rep. Jane Harman, D-Venice (Los Angeles County) has come up with a new way to expand the domestic "war on terror." Her Violent Radicalization and Homegrown Terrorism Prevention Act of 2007 (HR1955), which passed the House by the lopsided vote of 404-6, would set up a commission to "examine and report upon the facts and causes" of so-called violent radicalism and extremist ideology, then make legislative recommendations on combatting it.

According to commentary in the Baltimore Sun, Rep. Harman and her colleagues from both sides of the aisle believe the country faces a native brand of terrorism, and needs a commission with sweeping investigative power to combat it.

A clue as to where Harman's commission might be aiming is the Animal Enterprise Terrorism Act, a law that labels those who "engage in sit-ins, civil disobedience, trespass, or any other crime in the name of animal rights" as terrorists. Other groups in the crosshairs could be anti-abortion protesters, anti-tax agitators, immigration activists, environmentalists, peace demonstrators, Second Amendment rights supporters ... the list goes on and on. According to author Naomi Wolf, the National Counterterrorism Center holds the names of roughly 775,000 "terror suspects" with the number increasing by 20,000 per month.

What could the government be contemplating that leads it to make contingency plans to detain without recourse millions of its own citizens?

The Constitution does not allow the executive to have unchecked power under any circumstances. The people must not allow the president to use the war on terrorism to rule by fear instead of by law.

National Guard "urban warfare" gun confiscation "drill"-psyop in Iowa town called off - Drills linked to coming civil unrest

Needless to say, the covert aim of these operations, while ostensibly training soldiers for action in foreign wars, is actually to acclimate both American soldiers and civilians to the use of U.S. military, National Guard, and police for martial law and the confiscation of firearms from U.S. citizens.

National Guard scraps plans to invade rural town

WorldNetDaily | By Drew Zahn | February 20, 2009

DES MOINES, Iowa – Following publicized reports that the Army National Guard was planning a military training exercise on the streets of a rural Iowa town, the commanding officers have called off the mock "invasion."

The Guard had planned a four-day urban military operation in tiny Arcadia, Iowa, population 443, sending troops to take over the town and search door-to-door for a suspected weapons dealer.

The exercise was designed as a mock scenario to give soldiers the skills needed for deployment in an urban environment, and military officials stressed that only households that consented to be part of the drill would be searched.

"It will be important for us to gain the trust and confidence of the residents of Arcadia," Sgt. Mike Kots, readiness NCO for Alpha Company, told Carroll's Daily Times Herald. "We will need to identify individuals that are willing to assist us in training by allowing us to search their homes and vehicles and to participate in role-playing.

The U.S. Army War College in November released a white paper called Known Unknowns: Unconventional ‘Strategic Shocks’ in Defense Strategy Development. The report warned that the military must be prepared for a “violent, strategic dislocation inside the United States,” which could be provoked by “unforeseen economic collapse,” “purposeful domestic resistance,” “pervasive public health emergencies” or “loss of functioning political and legal order.” The “widespread civil violence,” the document said, “would force the defense establishment to reorient priorities in extremis to defend basic domestic order and human security.”
